Credits do not expire, but they are non-refundable and non-transferable. We reserve the right to modify the pricing and credit system at any time.

You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider for any such purchases.

3. Intellectual Property

3.1 Our Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Cover Photo Generators and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cover Photo Generators.

3.2 User-Generated Content

When you use our Service to generate cover photos, you retain ownership of the content you create using our Service, subject to the rights granted to us in these Terms.

By using our Service to generate content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your user-generated content in any existing or future media. This license is for the limited purpose of operating, developing, providing, and improving our Service and researching and developing new ones.

You represent and warrant that: (i) you own the content created through our Service or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) you are not violating any third-party rights by creating and using the content; and (iii) the content does not violate any applicable laws or regulations.

3.3 Usage Rights

Cover photos generated through our Service may be used for both personal and commercial purposes, subject to the following restrictions:

• You may not use the generated content to create, develop, or improve any competing AI image generation service.
• You may not sell, license, or distribute the generated content in a manner that allows others to use, download, extract, or redistribute the content as stock images, templates, or standalone files.
• You may not use the generated content in any way that violates any applicable laws or regulations or infringes upon any third-party rights.

4. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To generate content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• To impersonate or attempt to impersonate Cover Photo Generators, a Cover Photo Generators employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Cover Photo Generators or users of the Service or expose them to liability.
• To attempt to circumvent any content-filtering techniques we employ or to attempt to access any feature or area of the Service that you are not authorized to access.
• To develop, support, or use software, devices, scripts, robots, or any other means or processes to scrape the Service or otherwise copy profiles and other data from the Service.
• To use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service.

5. Limitation of Liability

Cover Photo Generators, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Indemnification

You agree to defend, indemnify, and hold harmless Cover Photo Generators and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) content generated through the Service.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
